Terms and Conditions

Please see below the Terms & Conditions between customers and Luxe Library. The terms and conditions of Luxe Library’s service agreement with customers is outlined and it applies to the online rental of products. By signing up and/or purchasing services, you acknowledge that you have read, understood and accept these Terms and Conditions. 

  1. DEFINITIONS AND INTERPRETATION
    1. The following definitions shall apply to these terms and conditions:
a) Luxe Library means Luxe Library; a company registered in Ireland. The contract will be governed by and interpreted in accordance with The Laws of the Republic of Ireland. References to “us” or “we” shall be references to Luxe Library. References to “you” is the person hiring from us.
b) Rental Period means the rental period as stated and requested in the rental order made through our site and shall begin on the date specified in the reservation of the product(s) and end on the date the product(s) are safely returned and received by Luxe Library. For the avoidance of doubt, in the event that products are not returned to us on a day prior to or on the Return Date, the Rental Period shall be extended and shall only cease once the product(s) are safely returned and received by Luxe Library.
c) Services means the luxury handbag rental service provided by Luxe Library through this site.
2. Unless the context otherwise requires, references to ‘terms’, ‘conditions’, ‘terms and conditions’ or ‘these terms’ shall mean these terms and conditions.
3. Unless the context otherwise requires, references to Services (as defined above) shall be to the luxury handbag rental services offered by Luxe Library and, for the avoidance of any doubt, shall not include any services rendered or offered by any third party.
4. Clause and paragraph headings shall not affect the interpretation of these terms.
5. Any words following the terms including, include, in particular, for example or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms
  1. Our Charges
a) Charges for hiring goods
You must pay the hire charges as shown in the order. Hire charges will start at the day booked by you on the website and will continue until you have returned the goods to us in a clean and undamaged condition. Hire charges are due for the duration of  the time which you have the goods including Saturdays, Sundays and public holidays. You must pay all charges you owe when we ask them.
b) Late fees

The rental period of products acquired from the Luxe Library is a week (7 days) or a month (30 days) from the date outlined in the booking. If the rented product is not returned within the chosen rental period plus one grace day period there will be a late penalty fee of fifty euro (€50) per day that will be charged to the payment card or other payment methods provided and stored in your customer account, and you agree to pay such late fees, up to an amount not to exceed 100% of the Retail Value.  If you have not returned a product within twenty one (21) days after the return date, your late return will be considered a non-return and Luxe Library will charge your payment card the maximum late fee (100% of the product retail value when new) less any late fees that you have already paid. 

  1. Delivery and Collection Charges

 You must pay us any agreed charges for delivering or collecting goods.  

  1. When the Contract Starts

The contract comes into effect when you have placed an order and agreed to these conditions and we have accepted your offer.

  1. Cancellations

Cancellations made 48 hours prior to the delivery day will not be refunded.

  1. Your Responsibility when Hiring Goods

 You become responsible for the goods when you receive them. If the goods are delivered to you, this will be when your responsibility starts. Your responsibilities include protecting the goods and keeping them safe from weather, theft, vandalism or improper use. At the end of the hire period, you must return the goods unless you have made arrangements for us to collect them. Your responsibility does not end until the goods have been returned. You must not sell or in any way give up control of the goods. Third party leasing or selling is against our Terms & Conditions.

  1. Maintaining Hired Goods

We ask for you to treat our items as if they were your own. We understand that from time to time normal wear and tear will happen. Normal wear and tear consists of small removable stains, minor scratches and creasing of leather. These will be covered by us and you will not be charged. In the event that a product is returned beyond reasonable wear and tear then you agree that we can charge you for the cost of repairing or replacing the item. We kindly ask customers not to attempt to clean or repair any products themselves. You must make sure the goods remain safe, clean and in good condition. If the goods are damaged in any way you must report this to us immediately. You must return the goods for us to examine unless we have agreed otherwise. You must tell us immediately if the goods are involved in any accident resulting in damage to the goods. You must take all necessary steps to make the goods safe and to protect them against theft and damage.

  1. Return Policy

In the instance of the item being lost, stolen or not returned to Luxe Library we reserve the right to incur charges as specified in the late fees section. In certain circumstances, we will be pursuing legal action in relation to items that are not returned. Luxe Library will provide you with a pre-paid return label as well as instructions for returning the borrowed item. You are responsible to return the item in the package that it arrives in and please ensure that the dust bag is also returned. Once you return the item you will be provided with a reference number, please ensure you keep this in the unlikely event of the item being lost during the return. Luxe Library is not responsible for any personal items left in the handbags. If you believe you have accidently sent us such items, please contact us.

  1. Limits of our Liability

a) All the times we quote for delivering the goods are approximate

b) We will not be liable for any delays caused by circumstances beyond our reasonable control

  1. Lost, Stolen, Damaged or Unclean Hired Goods

You must pay to us the cost of replacing any hired goods which are lost or stolen or damaged beyond economic repair (that is if the repair would cost more than the bag is worth). You are responsible for looking after the goods and returning them to us in good working order. Normal wear and tear consist of small removable stains, minor scratches and creasing of leather. These will be covered by us and you will not be charged. In the event that a product is returned beyond reasonable wear and tear then you agree that we can charge you for the cost of repairing or replacing the item. You must pay us reasonable costs of repairing or cleaning the goods if you return them damaged or unclean.

  1. Limits

Purchasing of services from Luxe Library is based on our discretion. We reserve the right to place limits on rentals and the number of products purchased by one person. 

  1. Communication

In registering and operating an account or signing up to our mailing list, you agree that ancillary to the services we may send you communications (by telephone, email, SMS text message, through our site or otherwise) as part of the day-to-day operation of the business. You may opt-out of receiving communications at any time. If you decide to opt-out of receiving communications, we retain our rights to contact you as may be required in the event of any dispute.

  1. Separate terms

If any term in this contract cannot be enforced, this will not affect the remaining terms.
